Hunter Biden might no longer be able to invoke the Fifth Amendment against self-incrimination because of the vast protections he received when his father, President Joe Biden, issued him a broad pardon, Judge Andrew Napolitano told Newsmax on Monday.
Napolitano told “Newsline” that “pleading the Fifth means you’re not going to answer something because you think the answer might incriminate you. But if you have been pardoned, then an incrimination is impossible, so he may very well have undermined his son’s ability to invoke the Fifth Amendment should he be brought before Congress.”
Napolitano said the most likely result of such a scenario is “if he speaks truly and does not evoke the Fifth Amendment, [there] will just be some embarrassment for the son and maybe for Joe Biden himself as well, [but] he still can’t be prosecuted.”
